היועמ"שית לבן גביר: "שימוע למפכ"ל אינו חוקי, שיקולים זרים"

היועצת המשפטית לממשלה גלי בהרב-מיארה הודיעה לשר לביטחון לאומי כי הזמנת המפכ"ל קובי שבתאי אינה חוקית, ולפיכך אין לקיימו. לדבריה, המפכ"ל פנה אליה ודיווח כי בן גביר "חורג מסמכותו כלפי המשטרה". היא הוסיפה: "מתעורר חשש כבד שאתה מבקש להעביר מסר לכל שרשרת הפיקוד במשטרה"

היועצת המשפטית לממשלה גלי בהרב-מיארה הודיעה הבוקר (שלישי) לשר לביטחון לאומי איתמר בן גביר כי הזמנת מפכ"ל המשטרה לשימוע אינה חוקית ואין לקיימו. "החשש הוא כי שיקולים זרים הנחו אותך בפעולתך", כתבה בהרב-מיארה. לדבריה, המפכ"ל פנה אליה ו"דיווח כי אתה שב וחורג מסמכותך כלפי המשטרה". 
"סמיכות הזמנים מעוררת חשש כבד כי במסווה של טענות עקרוניות כביכול נגד המפכ"ל אתה מבקש למעשה 'להענישו' על כך שביקש למנוע ממך להתערב באופן פסול בעבודת המשטרה, וכל זאת שעה שאתה פועל לכאורה בניגוד להחלטה המפורשת של בג"צ", כתבה בהרב-מיארה.
"מתעורר חשש כבד שאתה מבקש להעביר מסר לכל שרשרת הפיקוד במשטרה, למען יראו וייראו", הוסיפה היועמ"שית. לדברי בן גביר, השימוע יתקיים ביום רביעי הקרוב לפני המלצה שלו לממשלה להקדים את סיום כהונת המפכ"ל, שאמורה להסתיים ב-17 ביולי - בעוד פחות מחודשיים. 
על טענת בן גביר, שלפיה המפכ"ל לא מתפקד, אמרו מקורבי שבתאי: "המפכ"ל עבר ניתוח מסוכן לפני כחודשיים וחזר לעבודתו בניגוד לעצת רופאיו. בישיבת סגל הפיקוד הבכיר הוא אף אמר: 'בגלל השר כמעט השארתי כליה בבית החולים'".
